Property Transfers by Court

Personal property that is subject to a family use and possession order may be granted to either party by the court.  Before 2005, personal property could not be granted to either party, but after a use and possession order expired, would be ordered sold and the proceeds divided.  Now, the court has the authority to grant ownership of personal property to either party.

Commencing October 1, 2006, the court has the authority in a proceeding for annulment or absolute divorce, to transfer ownership of the marital home subject to the terms of any lien.  The court will be able to transfer ownership of an interest in real property jointly owned by the parties and used as the principal residence of the parties when they lived together.

Child Support Guidelines

Commencing October 1, 2007, the Maryland Child Support Guidelines will include the cost of health insurance for the minor children as an expense to be divided between the parties pro rata so that the obligor's total child support obligation will include his or her pro rata share of the health insurance cost for the minor children.
